Terms and Conditions for Hair and Beauty Training Courses

Please read these Terms and Conditions ("Agreement") carefully before accessing or using our website and purchasing our Hair and Beauty Training Courses ("Courses"). This Agreement sets forth the legally binding terms and conditions for your use of our website and participation in our Courses.

  1. Acceptance of Terms

By accessing our website and purchasing our Courses, you agree to be bound by this Agreement and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our website and participating in our Courses.

  1. Course Information

a. We strive to provide accurate and up-to-date information regarding our Courses. However, we do not warrant the accuracy, completeness, or usefulness of any information provided. It is your responsibility to evaluate the information and determine its suitability for your needs before purchasing a Course.

b. We reserve the right to modify, update, or discontinue any Course without prior notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of a Course.

  1. Registration and Payment

a. To access our Courses, you may be required to register an account on our website, and selected third party websites, you must provide accurate and complete information.

b. Payment for our Courses is required at the time of purchase and you are responsible for any additional fees or charges associated with the payment process.

c. We offer various payment options, including Klarna. By selecting Klarna as your payment method, you agree to comply with Klarna's terms and conditions and privacy policy. Klarna may perform a credit check or use other verification methods to assess your eligibility for their services. We are not responsible for any issues or disputes arising from your use of Klarna's services.

d. We use secure third-party payment processors, including Klarna, to handle payment transactions. We do not store any credit card or payment information on our servers.

f. In the event of a payment dispute or chargeback, we reserve the right to suspend your access to our Courses until the issue is resolved. You are responsible for any costs or fees incurred by us as a result of the dispute or chargeback.

  1. Discount Codes and Pricing

a. If you have a discount code or credit on your account, please apply it at the checkout. Discount codes and credits will not be accepted once payment has been made. It is your responsibility to ensure that the discount code or credit is applied correctly before completing the transaction.

b. Kleek Training reserves the right to change course prices or run offers at any time. The prices displayed on our website at the time of purchase are final and binding. Once a course booking has been made, the price paid is final, and no price difference can be refunded retrospectively in the event of a course price reduction or subsequent offer.

c. Discount codes may have expiration dates and specific terms and conditions associated with them. These terms and conditions will be communicated along with the discount code. It is your responsibility to review and comply with the terms and conditions of any discount code you wish to use.

  1. Booking confirmation

a. Whether you book a training course online or over the phone, you will receive a confirmation email within 24 hours to confirm your booking. 

b. Please be aware that a payment receipt does not constitute a booking confirmation. Only the confirmation email serves as the official confirmation of your booking.

c. If you have not received a confirmation email within 48 hours of making your booking, please contact Kleek Training immediately. You can reach us at 01325 341621 or by emailing info@kleektraining.co.uk. We will promptly address the issue and ensure that you receive the confirmation email as soon as we confirm payment has been made.

d. Payment receipts are available upon request for a period of up to 12 months after the course date. Please note that only VAT registered businesses can be issued with a VAT receipt or invoice.

 

  1. Refunds

a. All course fees are non-refundable and non-transferable. Once a course booking has been made and the payment has been processed, no refunds will be provided.

b. In the event of a cancellation by Kleek Training due to circumstances within our control, such as the unavailability of an instructor or a change in the course schedule, we will offer alternative training dates.

c. Kleek Training is unable to offer refunds for cancellations due to force majeure. In these events, we will make every effort to offer alternative training dates. However, Kleek Training cannot be held responsible for any loss of income, accommodation/traveling costs, or any other expenses incurred by clients due to the cancellation or rescheduling of courses caused by force majeure.

d. We reserve the right to cancel or reschedule a Course due to unforeseen circumstances. In such cases, we will make reasonable efforts to notify affected participants and provide alternative arrangements.

  1. Rescheduling

a. Kleek Training will consider each rescheduling request on its merits. However, it is at the academy's discretion as to whether a rescheduling request will be granted. Proof of reason may be requested to support the rescheduling request.

b. If Kleek Training deems the reason provided to be valid, an administration fee of £50.00 per course date will be charged for rescheduling. This fee covers the administrative costs associated with processing the rescheduling request.

c. Failure to provide prior notice of non-attendance or a late rescheduling request may result in the full loss of course fees. It is essential to notify Kleek Training in advance if you are unable to attend a scheduled course and an alternative may date may be offered.

d. In cases where rescheduling is agreed upon, but a rescheduling date is not available, a credit for all or part of the course fee may be placed on file as a gesture of goodwill. However, the issuance of credits is at the discretion of Kleek Training.

e. Any credits issued will be valid towards full-price training courses only and will remain valid for a period of 6 months from the date of the rescheduling request. After this time, any remaining course fee on account will be forfeited.

f. Please note that under no circumstances can course fees be refunded. Rescheduling requests should be directed to Kleek Training for further assistance and processing.

  1. Intellectual Property

a. All content and materials provided as part of our Courses, including but not limited to text, graphics, images, videos, and course materials, are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our Course materials without our prior written consent.

b. You acknowledge that the information and techniques taught in our Courses are intended for personal use and professional development. You agree not to use, share, or teach any of the course materials or techniques for commercial gain or to compete with our business.

  1. Limitation of Liability

a. To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our website or participation in our Courses.

b. You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to your use of our website or participation in our Courses.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of the United Kingdom.

  1. Changes to the Agreement

We reserve the right to update or modify this Agreement at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our website and participation in our Courses after the posting of any changes constitutes your acceptance of such changes.

  1. General Terms

a. Attendance and Course Amendments: In the event that you are unable to attend your original training dates for any reason and the course is later amended in content or removed from our list of courses offered, please note that no refund will be offered. However, we do offer the flexibility to utilize any course fees on account towards an alternative course within 6 months of the original booking date.

b. Timeframe for Booking and Rescheduling: We kindly remind our clients that it is essential to book, attend, or reschedule training within 6 months of enrolling upon their course, starting from the date of payment. Failure to do so will result in the loss of any course fees on account. Unfortunately, we are unable to offer refunds or further credits in these circumstances.

  1. Minimum Student Age

We can only accept clients aged 16 years or over for our training courses.

  1. Specific Needs

a. Medical Conditions: We understand the importance of accommodating specific medical conditions during our courses. Therefore, we kindly request that you disclose any relevant medical information at the time of booking. Rest assured that all information shared will be treated with the utmost confidentiality. Please note that in certain cases, we may request a medical certificate to ensure the best possible adjustments and accommodations are made.

b. Special Educational Needs Training: We strive to provide an inclusive learning environment for all our clients. If you have any particular learning requirements, please inform us so that we can make the necessary adjustments and ensure your practical training runs as smoothly as possible. While we aim to include clients with special needs within our main course delivery, we understand that tailored training on a one-to-one basis may be more suitable in some instances. Please note that an additional cost may apply for one-to-one training.

  1. Models

For courses that require a live model, it is your responsibility to find a suitable person who meets the necessary criteria. This includes ensuring that they have no contraindications or conditions that could interfere with their ability to receive the treatment. Additionally, you are responsible for ensuring your model's punctuality and that they have undergone patch testing 24-48 hours before the course start date. Failure to meet these requirements will impact your ability to complete the course, and all fees will be forfeited.

  1. Discrimination, Equality, and Bullying

a. Inclusion and Respect: At Kleek Training, we embrace diversity and inclusivity. While our courses may involve mixed-sex groups, we understand that there may be circumstances where you require training in a same-sex environment. If this is the case, please contact us before booking the course, and we will make every effort to accommodate your needs. We take all personal requests seriously and strive to ensure that every client feels comfortable throughout their training experience.

b. Tolerance and Support: We believe in creating a supportive and inclusive learning environment for all our learners. We value tolerance and patience towards individual abilities within the group. If you notice another learner who may be struggling, we encourage you to discreetly inform your tutor. Discriminatory or bullying behaviour will not be tolerated and will result in immediate removal from the course without a refund.

  1. Use of Phones/Cameras and Photography

To maintain a focused learning environment, the use of phones or cameras for photography or video purposes is not permitted during training courses. Comprehensive training notes will be provided for your reference. Occasionally, tutors may take photos or videos during training courses, subject to the prior consent of all participating clients. The usage of such images will be discussed on the day, primarily for marketing purposes. If you have any concerns regarding photography due to religious or safety reasons, please inform your tutor as soon as possible.

  1. Starter Kits

All course attendees will receive a complimentary starter kit specific to their purchased course.

  1. Public Liability Insurance

After completing your practical training, you will have the opportunity to apply for insurance through The Beauty Guild, enabling you to work on members of the public. If you have your own provider, please ensure that you verify with your preferred insurer whether they accept the Beauty Guild qualification before booking your course. Insurers have their own discretion in choosing preferred training providers. If you have an existing policy, it is your responsibility to check if the new treatment(s) are covered and any associated costs for adjustments. Kleek Training cannot be held liable for issues arising with insurance companies due to failure to check prior to booking.

  1. Complaints

a. Commitment to Outstanding Training: At Kleek Training, we are committed to providing exceptional training experiences to all our clients. If you encounter any concerns on the day of your training, we encourage you to discuss them directly with your trainer, as most issues can be resolved promptly through open communication.

b. Escalating Concerns: In the event that you feel unable to discuss your concern with your trainer, please reach out to us via email at info@kleektraining.co.uk, providing details of the difficulty or issue you faced. We kindly request that you submit such emails within 5 days of your training course. Rest assured that we treat all feedback seriously and confidentially. Our management team will thoroughly investigate and address any complaints, aiming to respond to all correspondence within 5 working days.
